Codewithonlythoserightssetforthherein.

11.MISCELLANEOUS.

ThisLicenserepresentsthecompleteagreementconcerningsubjectmatterhereof.IfanyprovisionofthisLicenseisheldtobeun-

enforceable,suchprovisionshallbereformedonlytotheextentnecessarytomakeitenforceable.ThisLicenseshallbegovernedby

Dutchlawprovisions(excepttotheextentapplicablelaw,ifany,providesotherwise),excludingitsconict-of-lawprovisions.Withre-

risdictionofthecourtofAlmelo,TheNetherlandswiththelosingpartyresponsibleforcosts,includingwithoutlimitation,courtcosts

andreasonableattorneysfeesandexpenses.Anylaworregulationwhichprovidesthatthelanguageofacontractshallbeconstrued

againstthedraftershallnotapplytothisLicense.

12.RESPONSIBILITYFORCLAIMS.

ExceptincaseswhereanotherContributorhasfailedtocomplywithSection3.4,Youareresponsiblefordamagesarising,directlyor

indirectly,outofYourutilizationofrightsunderthisLicense,based onthenumberofcopiesofCoveredCodeyoumadeavailable,the

revenuesyoureceivedfromutilizingsuchrights,andotherrelevantfactors.Youagreetoworkwithaffectedpartiestodistribute re-

sponsibilityonanequitablebasis.
